REGULATORY ADVISORY
Please be updated and guided by the following implementing rules and regulation of ORDINANCE NO. 14671-2023:
AN ORDINANCE REPEALING ORDINANCE NO. 14421 – 2022, ENTITLED: “AN ORDINANCE, TO EASE UP OR LOOSEN UP THE IMPLEMENTATION OF THE MANDATORY WEARING OF SAFETY HELMET FOR MOTORCYCLE DRIVERS AND THEIR PILLION RIDERS WITHIN THE POBLACION AREA AND IN URBANIZED AREAS, SUCH AS BARANGAYS NAZARETH, MCASANDIG AND CARMEN (INCLUDING UPTOWN AREA), AND OTHER AREAS AS MAYBE IDENTIFIED BY THE CITY MAYOR: PROVIDED THAT THE 30-KILOMETER PER HOUR SPEED LIMIT THEREIN PURSUANT TO THE TRAFFIC CODE OF THE CITY IS COMPLIED WITH”
Repealing Ordinance No. 14421-2022
“To ease up or loosen up the implementation of the mandatory wearing of safety helmet for motorcycle drivers and their pillion riders within the poblacion area and in urbanized areas such as Barangays Nazareth, Macasandig, and Carmen (including uptown area)
WHEREAS, as presented during the Regular Session on November 13, 2023, statistical data on vehicular accidents in the City, showing a significant increase of motorcycle riders who were either brought to the hospital or became fatalities for not wearing helmet;
WHEREAS, the enactment of the said Ordinance has made many motorcycle riders complacent of their safety by not wearing safety helmet anymore;
WHEREAS, while the intention of the said Ordinance is laudable, it gave rise to substantial cases of damage to life and limbs; thus, it is imperative to repeal the same;
The city government wants to make sure all motorcycle drivers in Cagayan de Oro City are aware of a recent change in the helmet law. Ordinance No. 14671-2023 has repealed Ordinance No. 14421-2022, which previously eased up the mandatory helmet requirement in certain areas. This means wearing a helmet is now mandatory again within the poblacion area and in urbanized areas such as Barangays Nazareth, Mcasandag, and Carmen (including Uptown area).
Why the Change?
Unfortunately, data showed a significant increase in motorcycle accidents and fatalities involving riders who were not wearing helmets after the previous ordinance was passed. The City Council determined that the safety benefits of mandatory helmet use outweigh any inconvenience it may cause.
What You Need to Do:
Please ensure you always wear a properly fitted and certified helmet when riding a motorcycle within the designated areas. Remember, helmets can save lives!
